Terms of Service
These terms govern the use of the Thread & Tweed website and any order placed through it. They cover acceptable use, the formation of orders, pricing and payment, delivery, returns, the care of menswear, intellectual property, liability and the law that applies.
Website use
Access to the site is granted on the condition that it is used lawfully. Scraping, probing for vulnerabilities, submitting automated orders and any activity that degrades the service for other customers are prohibited.
Access may be suspended or blocked where fraudulent activity or persistent misuse is detected, and orders placed by automated means may be cancelled without notice.
Customers are responsible for maintaining the confidentiality of any account credentials issued to them and for notifying Thread & Tweed promptly if those credentials may have been obtained by another person.
Where any part of these terms is not accepted, the site should not be used; questions about individual clauses may be raised before an order is placed.
Access to the site is provided on an 'as available' basis. Maintenance and security work may require part of the site to be unavailable for a period, and where such work affects an order already placed, the customer is contacted rather than left to discover it.

Orders and acceptance
An order constitutes an offer to purchase. A contract is formed when Thread & Tweed confirms dispatch, not when the order is placed.
An order may be declined where an item is out of stock, where payment cannot be verified, where the delivery address is incomplete or where fraud is suspected.
Where an order is cancelled after payment has been taken, the full amount is refunded and a reason is given.
Order confirmation emails are a record of the order received; the dispatch email is the point at which the contract is complete.
Where an item shown as available proves not to be, the customer is told before payment is taken rather than after, and may cancel the remainder of the order at that point. Where an order is amended before dispatch, any difference in price is refunded or charged accordingly.

Pricing and payment
Prices are displayed in US dollars and may be changed without notice. The price confirmed on the order email is the price that applies to that order.
Sales tax is calculated at checkout from the delivery address. Payment is taken on the processor's hosted page, and full card numbers are never stored by Thread & Tweed.
The accepted methods are described in the Payment Policy, which forms part of these terms.
Where a price has been displayed incorrectly as a result of a technical fault, the customer is contacted before dispatch and may either proceed at the corrected price or withdraw for a full refund.
No surcharge is applied for paying by credit card, and no discount is offered for any particular method. Where a promotion has been applied, the discounted figure is displayed before the order is confirmed and is the figure used for any subsequent refund.

Delivery
Delivery dates are estimates rather than guarantees. Thread & Tweed is not responsible for delays caused by the carrier, severe weather, an incomplete address or a consignment that is not collected.
Risk passes on delivery, but where a consignment is lost or damaged in transit Thread & Tweed pursues the carrier and offers a replacement or refund once the claim is settled.
A delivery that fails because the address was incorrect leaves the customer liable for the cost of retrieving the parcel and dispatching it again, unless the error originated with Thread & Tweed.

Where the carrier offers a delivery window or a collection point, that arrangement is between the customer and the carrier once the consignment is in the carrier's network. A consignment cannot be redirected to a different address after dispatch.

Returns and refunds
An unused item may be returned within 30 days of delivery in accordance with the Return Policy, which forms part of these terms.
Refunds are issued to the original payment method within seven calendar days of the returned item passing inspection. The bank's own posting time is additional and outside that period.
Where these terms and the Return Policy appear to conflict on a returns matter, the Return Policy is the more specific document and prevails.
Nothing in this section reduces a statutory right that cannot be excluded by agreement.
Returned items remain the customer's responsibility until they reach Thread & Tweed, which is why a tracked service is recommended for anything of value. Where the original card has expired, the customer should contact [email protected] once the bank confirms the closure, and an alternative arrangement will be made.

Product care and safety
Care instructions are printed on the label inside each garment. Natural fibres can relax or shrink slightly after the first wash, and colours may soften over time, which is normal rather than a fault.
Care instructions published on the product page, and on any label supplied with the item, form part of the basis on which the item is sold. They should be followed, and any apparent conflict between the label and the product page should be reported so that the listing can be corrected.
Damage arising from misuse, from disregarding the care instructions or from altering an item beyond its intended purpose is not covered by the Return Policy or by any warranty that may apply.
Where a product is supplied with a manufacturer's warranty, that warranty operates alongside these terms rather than replacing them.
Where the instructions supplied with an item appear to contradict the product page, the instructions supplied with the item should be followed and the discrepancy reported so that the listing can be corrected.
Care guidance is published for the benefit of the customer, and following it protects both the item and, where relevant, the person using it.

Intellectual property
The text, photography, graphics, page layout and the Thread & Tweed name are owned by Thread & Tweed or used under licence, and may not be reproduced without written permission.
Linking to a product page and quoting a short extract in a review or article is permitted, and images may be supplied for genuine editorial use on request.
Third-party names, logos and brand marks remain the property of their owners, and nothing on the site grants a licence to use them.
Using the Thread & Tweed name, logo or photography in a manner that suggests endorsement or connection with another business is not permitted.
Where a third party owns a product name, logo or brand mark referred to on this site, ownership remains with that party; nothing here grants a licence to use it.
A request to use Thread & Tweed photography for editorial purposes is usually granted, provided the images are not altered and the source is credited.

Prohibited conduct
The following conduct is prohibited: submitting unlawful, abusive or misleading content through the site; using another person's payment details; interfering with the security or availability of the service.
Ordering goods with no intention of paying, or repeatedly returning used items as though the return policy were a lending service, is also prohibited.
Accounts may be suspended while an investigation is open, and the reason for any suspension will be given.
Fraudulent payment activity may be reported to the relevant authorities, and future orders may require an alternative payment method while a matter is resolved.
An order that appears unusual may be subject to additional verification. That is a routine check rather than an accusation, and it is released as soon as the details match the record.

Limitation of liability
To the extent permitted by law, Thread & Tweed is not liable for indirect or consequential loss arising from the use of the site or from the purchase of a product.
Nothing in this section excludes liability for death or personal injury caused by negligence, or for fraud, and nothing removes a statutory right that cannot be waived.
Liability for any claim relating to an order is limited to the amount actually paid for that order.
Where a product causes damage to property, the position depends on whether it was used as intended and on the terms of any manufacturer warranty; the available options are explained once the circumstances are understood.
Nothing in this section is intended to discourage a customer from raising a genuine problem, and it does not shorten any period within which a claim may be brought.

Changes to terms
These terms may be amended to reflect changes in the business or in the law. The version published on this page is the version in force.
Continuing to use the site after an amendment indicates acceptance of the amended terms. The date of the most recent revision is shown at the top of the page.
Amendments are not applied retrospectively to orders already placed, and the terms in force at the time of purchase continue to govern that purchase.
Previous versions are retained and may be requested by quoting the order reference.
If a change materially reduces a customer's rights, that fact is stated at the top of the page rather than left to be discovered in the text. Where an amendment is required by law, it takes effect from the date the law requires rather than the date of publication.

Governing law
These terms are governed by the law of the United States and of the state in which Thread & Tweed's registered office is located, disregarding conflict-of-law rules.
Where a disagreement cannot be resolved by correspondence, the parties agree to attempt mediation before proceedings are issued.
The courts of that state have exclusive jurisdiction, save that nothing in this clause prevents a consumer from using a consumer-protection body or small-claims procedure available in their own state.
The governing law does not remove protections available under the consumer law of the customer's own jurisdiction, which apply alongside this clause.
Before any formal step is taken, the customer should write to Thread & Tweed with the order reference and a description of the problem; the majority of disagreements are resolved at that stage.

A response is provided within one working day, Monday to Friday. Any clause that appears unclear will be discussed rather than left unresolved.
Correspondence concerning a formal complaint or a data request is logged and answered in writing, so that both parties hold a record of what was said.
Where it is unclear which address to use, the message should be sent to the address above and will be routed internally rather than the customer being asked to guess.
Where a message concerns more than one subject, it will be answered in a single reply covering each point, rather than being split across several responses.
